NANNAH KHAN versus BARKHURDAR
The Mohammedan Law Constitution of Pakistan (1973), Article 185 (3) disputes relating to inheritance parties / two wives of the common ancestor were the landowners and the claimant was from the wife of the common ancestor while the applicant was born to another wife. The respondents are real brothers. Thus, the deceased was entitled to inherit his twin brothers; both sides are in joint possession of the underground land, the land left to the deceased by merely wrong entry in the revenue record.
