MUSHTAQ AHMAD CHAUDHRY versus SECRETARY, MINISTRY OF FINANCE, GOVERNMENT OF PAKISTAN, ISLAMABAD
The Constitution of Pakistan (1973), Article 185 (3), paid for the Secretariat Allowance, was based on the claim of the Secretariat Allowance that such allowance was being given to government employees in other provinces and was being paid to employees. Government employees in other departments further stated that they did not withdraw the Secretariat Allowance on May 31, 1994, they should not be extended to the same benefit through the Finance Act, 1994. The notice of appeal was granted with this direction. It was said that the provisional relief secretariat allowance from May 31, 1994, until the matter was settled, would be subject to the condition that it would be recovered if the court finally declared the government employees entitled to pay the secretariat allowance.
