ABDUL HAMID versus SHABBIR KHAN
NWFP Pre-Trouble Act 1987 Section 13 Constitution of Pakistan (1973), Article 185 (3) suits for pre-emption, with one of the plaintiffs who bought the land equally in two share sellers. On the basis of consent, accepting the right to own the previous writ, the boundary of the 1/2 part of the land in question was passed in favor of the plaintiff, however, after that, all the courts had granted it to the High Court. Was approved by the court, in which the appeal for an appeal waiver was granted or not, with the plaintiffs going to trial. On the part of the respondents (the vendor) who agreed on the basis of the agreement, the request for the review of the other respondents (who did not compromise) could not be justified on the one hand, as it did not in any way affect the property. I was not impressed with that part. The basis of the agreement was not initially challenged by the consent of the respondents, and the matter compiled by the High Court is concerned only with the effect of the compromise decree on the rights of the respondents. The courts had no jurisdiction to enter into a dispute of disputes which had become irrelevant after the parties had agreed.
