The offense of adultery (Enforcement Hood) Ordinance 1979 Section 16, without being found guilty of the offense, was upheld by the trial court under section 10 (2) of the Enforcement of Adultery (Enforcement) Act 1979. He was charged, but he was convicted and sentenced under section 16 of the said ordinance for which no charge was made against him as the accused was not charged under section 16.
