MUHAMMAD SHAFT versus SHADI KHAN
Criminal Code of Conduct (CCPC) Section 145 (6) of the Constitution of Pakistan (1973), Article 199, after the magistrate held that the applicant had occupied the land in the dispute within two months before the order was passed and forced. And the defendant relinquished his title to the judgment of the plaintiff rather than restoring the possession of the land; the magistrate improperly disposed of the applicant within two months after reaching that decision. Prior to the date of the next order when the other party was forcibly and wrongfully disposed of the land in the wake of the dispute, it was the responsibility of the applicant to restore his possession of the Constitution. The petition was accepted and the amendments were made to lower court orders.
