The appearance and absence of the CPC of the Civil Procedure Code Order IX resulted in alleged fraud and misrepresentation of the OI, R 13 and Section 12 (2) Constitution of Pakistan (1973), Article 185 (3) ex parte decree. No attempt was made to present the defendants (women) personally; the proper procedure was not followed in the service of the summons. Declared deposed former with justification given partial order against women (defendants) and ordered a trial de novo
