The Constitution of Pakistan (1973), Article 185 (3), hearing the petition for the transfer of government employees, was held by the High Court on the ground that such an order was made on the recommendation of the MPA. The appeal was granted to consider whether the High Court had no jurisdiction to set aside the transfer order relating to the Terms and Conditions of Service and the Service Tribunal had exclusive jurisdiction over the matter. ?
