Under Section 103AA of the Representation of the People Act, 1976, the conditions under which the Election Commission should be subject to the jurisdiction of the Election Commission should be drawn. Two conditions must be met before The Election Commission is attracted to: (i) that there should be unlawful limits or violations of the provisions of the Public Representation Act, 1976, or the rules made thereunder (ii) to disclose the facts appearing in the face of the record If there is a serious wrongdoing or violation of the provisions of the Act or the rules, a summary inquiry may be considered as necessary by the Election Commission.
