The test and its inquiry were conducted in a biased manner, even though the facts and circumstances had led to speculation against the appellant corporation, it was only 30 paise more than the respondent said it contradicted the appellant. Even though the accused could not be recovered, all these facts led to serious doubt and the dismissal order was not enforceable on the basis of such inquiry.
