The risk and cost was that if the plaintiff succeeds in the lawsuit, he will not suffer because the defendant was not claiming compensation from him, so no improvement can be sought by any seller when premature. If any construction was made after filing a lawsuit for impression, the plaintiff was the plain buyer and unless a decree was granted against it. So long as the property is in full use of the property, as long as the prohibition of the legitimate owner was unconstitutional, the modification provided under the fundamental rights was excluded.
