MUHAMMAD QUTUBUDDIN versus FEDERATION OF PAKISTAN
Section 13 (ii) (2) Constitution of Pakistan (1973), Article 199 Retirement of Government Employees who retired from service after completing 25 years under Section 13 of the Government Employees Act 1973, made their retirement before the Service Tribunal. About two years after the applicant's retirement, the Federal Shariah Court ruled that the provisions of section 13 of the said Act violate the integration of Islam and the Federal Shariah Court decision. The Supreme Court maintained and set a target date for the relevant amendments. The lawsuit filed a constitutional petition in the light of the Supreme Court's decision about six years after his retirement, which was otherwise filed after a six-year hiatus from retirement, because he was completely ousted. Applicant who has already approached the Federal Service Tribunal to deal with it. Respecting the same complaint, he did not disclose the fact that the second verdict in his memorandum was filed by the Supreme Court.
