The Pakistan Penal Code section 411 defined the evidence as the fugitive co-accused was physically taking the buffalo with him and the suspects were recording from a distance where the accused had joined the fugitive co-accused and his innocent passenger. The possibility of being involved cannot be excluded because the buffalo was in the physical possession of the accompanying accused, therefore, it cannot be said that the accused did not know that the theft was done. Therefore, the prosecution did not prove its case against the accused. The suspects were acquitted beyond reasonable doubt
