Industrial Relations Ordinance 1969 Section 25 A reverse appellant, acting as Mistry, alleged in the Railway Department that he was returned without notice. The department claimed that the appellant was working on a work post that was not approved for another period. The appellant had no right to that position and his return to the concrete post did not amount to any punishment which required the showcase notice. The person who filed the written statement did not inspect the oath. The counter statement could not be said so the Department was unable to produce any document to prove the oath to show that he acted in the capacity of the appellant after the initial period on the basis of the work charge. Until this was reversed, the Department's work was not ordered to extend such a term. From time to time, until his reversal, only the oral statement of the witness to the department on which the appellant was working had been prepared for the work charge post. Was entitled to be regular upon completion of the service, the applicant's return without charge sheet and showcase notice was illegal and the appellant shall be deemed to be regular as Mistry after the completion of three years service post. The appellant was acting against, the inability or failure of the relevant staff of the department to issue regular orders will be considered as regular.
