Article 199 The Constitutional Jurisdiction Jurisdiction The applicants for misappropriation of funds were members of the Cooperative Housing Society, who had made serious allegations of misappropriation of funds against the officials, and such defendants. The High Court generally failed to exercise its constitutional jurisdiction. An exercise in determining complex, contested and complex questions of fact can be established without any extensive investigation of complex or controversial facts. In order to investigate the serious allegations of alleged misappropriation of millions of rupees and plots, detailed investigation / evidence was needed, which could not have been done by the High Court. The proper way for applicants to sit in the exercise of constitutional jurisdiction was to pursue pending litigation or consult the appropriate courts to resolve their complaints.
