KHAN MUHAMMAD versus SENIOR SUPERINTENDENT OF POLICE RAWALPINDI
Articles 5 and 6 constitution of Pakistan (1973), Article 1212 (3) after the partial approval of his departmental appeal from the service police officer, filing a review before the higher authority after which no hearing appeal has been filed. After that, the time restriction was rejected before the service tribunal because such an order was canceled before the Supreme Court with the argument that the time limit for filing a review was beyond the limits of sanctions. Should have been excluded, though such periods also cannot be excluded. Well, the delay should be condoned in this regard, the time taken for the unqualified forum and the acquisition of a remedy before the specified day, after that, there can be no justification for interfering with the facts related to the refusal to delay. Observations were made on the merits of the case made by the service tribunal which were questions of fact, not of any weakness. Leave to appeal
