Section 497 of the Code of Conduct (XLV of 1860), Section 392 accused were designated in the FIR for further investigation without any role, because no one was identified at the time of the incident and the accused. There was no way to identify which two eyewitnesses could not comment on because it was not supported by any other independent evidence. The complaining party cannot be expected to carry 30 bore pistols that were robbed by the accused, the accused could not be held behind bars only on the basis that he was guilty. And in other criminal cases he was required, unless such a case could be proved against him, further investigation into the accused was required and accordingly he was admitted on bail.
