MUHAMMAD SIRAJ KHAN versus RETURNING OFFICER
Holding the Order of the General Election (Article 7 (2002)) of Article 99 (CC), Article 8 (a) of the Constitution of Pakistan (1973), Article 199 On the request for eligibility eligibility to contest the election, the applicant questioned whether the educational candidate. The eligibility of the nomination was not recognized by the Higher Education Commission for the purpose of equivalent degree / graduation in which the certificate was awarded to the candidate required to contest the general election which had the educational qualification to nominate the candidate. The foundation was laid. The Provincial Assembly was issued by an institution which mentioned in the relevant notification that the degree conferred by the Bachelor Degree in any law related confiscation or any degree recognized by the University Grants Commission There was talk, too, that it would enable a candidate to contest academically. The Assembly Returning Officer as well as the Election Tribunal did not properly interfere with the candidate's nomination papers for the final result of the Authority's failure to enter into legal residency or defect in the jurisdiction. The Constitutional petition cannot be interfered with by the High Court.
