SUGHRAN BEGUM versus ADDITIONAL DISTRICT JUDGE, LAHORE
The rent controller granted permission for the removal of sections 13 and 15 of the West Pakistan Citizens Rental Restriction Ordinance 1959 filed by the landlord against the tenant, but the appellate court accepted the tenant's appeal, contrary to the rent controller. The order maintains that none of the parties have title documents in respect of the premises. In a dispute, they must first obtain their rights with the civil court in the dispute directly and substantially in the previous civil suit against the landlord for a permanent injunction by the tenant which was decided by the High Court. The appeal was upheld in favor of the landlord. Former courts were obliged to determine the court's conclusions regarding the current withdrawal proceedings between the parties regarding civil litigation; this decision by the appellate court, without examining the aforementioned aspects of the case, Could not be sustained.
