Sections 46 and 48 of the Constitution of Pakistan (1973), Article 185 (3) were terminated without charge on the leave workman on duty and on the recommendation of the inquiry officer, he was appealed by the Labor Court to the employees. On the basis of a thorough investigation, the Inquiry Officer concluded that employees were guilty of misconduct due to lack of duty and late arrival within the stipulated period. The lawsuit was fully upheld against the employees.
