BASHIR AHMAD versus HAJI MUHAMMAD ASHRAF
The accused applicant filed a private complaint before the Sessions Court in the year 2000 following the police challan case under Section 324/148/149/395/511/109/452 Constitution of Pakistan (1973), Article 185 (3) transfer of cases. Was Section 2302, PPC, in which the accused was summoned by the trial court, was earlier dealt with by the trial court in the police challan case, though a private complaint under section 2302, PPC, was earlier engaged in the aforesaid cases. The accused and the applicant's private complaint was postponed on the basis of the prescription, it was not alleged that he had ever tried to extend the case or delayed the case before the Meteor Magistrate for any reason. This feature has been encountered because such features, not directly or indirectly, were brought to the top. The personal complaint of the accused under the Meteor Magistrate and the state case was withdrawn from the said court and transferred to the Sessions Court. The application for leave to appeal the circumstances was changed by the Supreme Court of Appeal and allowed accordingly
