NATIONAL COLLEGE OF BUSINESS ADMINISTRATION AND ECONOMICS, LAHORE versus HIGHER EDUCATION COMMISSION OF PAKISTAN
The applicants of the Constitution of Arts 10A and 1991 have not heard a competent hearing on the principles of natural justice, and the applicant has regretted the order approved by the Higher Education Commission, whereby the Higher Education Commission asked the question. Prior to the issuance of the permit, the affiliated educational institutions were withdrawn. Notices were issued to the applicant institute or its affiliated educational institutions, nor were they provided with any opportunity to be heard and this is a violation of the principles of natural justice, guaranteed under Article 10A of the Constitution. The fundamental right of the individual is the right. The Higher Education Commission was unlawful, contrary to the principles of natural justice and violation of Article 10A of the Constitution, therefore, the High Court directed that the Higher Education Commission strictly observe any legal proceedings within its jurisdiction.
