MST. SHAHIN SHAH BIBI versus MUSHARAF

The settlement of the dispute between the Settlement Dispute Resolution for the declaration of Article 42 was already settled in the Jirga, after which a declaration and division case was filed against the same property but the Appellate Court set aside the decision as legal. The arrangements and distributions declared as private are entitled to the same sanctity as are lawful contracts and should not be interfered with in any legal proceedings unless the private arrangements or divisions are legally justified and Private arrangements were not done periodically and parties and applicants followed suit ? The law could not be turned around by asking for a fresh request before the removal of any law reviewing court.
