Section 4 Special Relief Act (I of 1877), Section 42 Occupancy Tenant, the property rights scope discovery suit in which the applicant had set up against the defendants in relation to the suit land, dismissed the petitioner's petition. The applicants were of the view that they were the original owners of the suit land, while the defendants were their tenants and could not acquire the proprietary rights in the suit land which the Diversity Revenue Record was without any objection to any party. During the hearing, the Revenue Officer was prepared. The position the applicants took in respect of the acquisition of property rights in the suit property did not prove that, at the time of the declaration of the Khyber Pakhtunkhwa Tenancy Act 1950, the defendants or their predecessors paid cash or some kind of rent. Responding to the suit property, the respondents had obtained the status of the owners of the suitland property. The review of the payment for any compensation was excluded.
