LAHORE DEVELOPMENT AUTHORITY THROUGH DIRECTOR-GENERAL versus COMMISSIONER, LAHORE DIVISION, LAHORE

Section 4 and 54 of the Amendment Ordinance (XII of 1972), Section 2 intra-court appeal restoration proceedings were initiated before the High Court single judge under the provisions of the Land Acquisition Act, 1894, in the event of an order being passed in such proceedings. In this, his right was available for appeal to the aggrieved party pursuant to section 44 of the Land Acquisition Act, a division bench of the High Court refused to interfere with the decision of a single High Court judge in exercise of constitutional jurisdiction.
