A similar case was filed by the plaintiff, before the declaration and dismissal of the permanent injunction in Articles 42 and 54 Civil Procedure Code (v. 1908), O VII, R 11 suit, which was unlawful Excluded for prosecution, although excluded was illegal prosecution, but excluded on the date it was not raised for hearing but when a different request for response and argument was made. It was said that the order of dismissal was without jurisdiction, though earlier it had been said that an application for reinstatement should be filed. The suit for the recovery of the plaintiff will be filed in the successor court of the plaintiff and the proceedings of the trial will begin at the stage where the earlier dismissal order was approved and the case will be decided according to law.
