RAJA MUZAFFAR HUSSAIN KHAN versus BOARD OF REVENUE THROUGH MEMBER MUZAFFARABAD
Appeal to the High Court Scope Parties, divided into sections 135 (VIII of 1974), section 42 (12) and 44 of the Azad Jammu and Kashmir, was a contributing partner to this ground, and if any party claimed It occupies the land. The other party had more than its minor share, then it was ordered by the Revenue Assistant to order the division of the land according to the shares. The shareholders had the right to apply for land distribution, and to distribute the land, and to enter. The orders passed by the Revenue Authorities in separate record of farm and crop number records and in this regard the decisions of the High Court were, in effect, legal if the results recorded by the lower tribunals were not based on any evidence, or the record. If so, the court may interfere with the finding of the lower tribunals under the special unusual jurisdiction under section 44 of the High Azad Jammu and Kashmir Interim Constitution Act, 1974. The record by the lower tribunals was on record. The High Court justified the writ petition. The appeal for leave of appeal was dismissed in the circumstances.
