NARGIS FIRDOS versus D.P.I. SCHOOLS ELEMENTARY, AZAD JAMMU AND KASHMIR, MUZAFFARABAD

Section 9 Azad Jammu and Kashmir Service Tribunal Act (XXII of 1975), Section 4 Transfer Appellant who was posted in the school as a teacher for 11 years, was transferred from that school, it was said that the transfer was canceled. The defendant filed an appeal against the cancellation of the transfer order before the service tribunal accepted the appeal filed by the defendant and set aside the cancellation of the transfer order. The medical certificate attached to the record did not suggest that the appellant was posted against the post of a disabled teacher at the BT at the school. Or she was permanently disabled from traveling to the appellant's transfer order after being justified for 11 years. The civil servant did not have the exclusive right to remain indefinitely at a particular station. There was no justification for the cancellation of the transfer order. Under the Circle, the mothers were excluded by the appellant for having no competence before the Supreme Court.
