NAZIR AHMED versus MEMBER (JUDICIAL-IV), BOARD OF REVENUE, PUNJAB, LAHORE
17 and 19 (2) Constitution of Pakistan (1973), Article 199 Constitutional petition was made as a limbardar, the appointment of the respondents and after the death of the limber, he was appointed by the Revenue Authorities as a limbardar. The applicant submitted that the defendant was not a liability to the public liability and could not be appointed as a limbar, neither as the deceased limber nor the respondents when Sarbakh was dismissed and there was no determination at that time. When the lumbering file was launched only before the parties competed, the revenue authorities applied for applicants and defendants. And there was a case. In the presence of the parties concerned, it was decided that the appointment of the lumberman was not correct. These were administrative steps and the Revenue Officers were appointed under the Best Judges Land Revenue Act, 1967. The selection of the collector was to be respected by the respondents. To no avail , High Court refuses to arbitrate in their favor, shocked at the circumstances
