GULZAR AHMED versus STATE

Section 9 (c) and 14 Criminal Code of Conduct (v. 1898), Section 561A & 265, had to convert a petition containing a drug application from a jurisdiction to a revision petition by the accused persons nominated in the FIR. Filed an application under section 265. , The application was dismissed before the CCP Special Judge's Court and when the aggravating order of dismissal moved the petition under section 56161A, the CCPCED application was considered as a revision request and The decision was made as a statement of the co-accused given during the investigation. The High Court was not brought to the Bench of the Bench which had passed the defamation order and as far as this particular aspect of the statement of the accused is concerned, the order of the Bench was an order under which such a case was proceeding. Nor can the High Court say that the statement of the co-accused has been fully considered and the review request dismissed.
