Section 5, Schedule to the Constitution of Pakistan (1973), Article 199 Constitutional Application Transitional Restitution Allowance, Increase of Compensation Against Interim Order of Rehabilitation, whereby the trial court approved the rehabilitation allowance for juveniles at a rate of Rs. 2000 per month. The court had approached the petitioner requesting Rs 3,000 per month for temporary care enhancement as the applicant believed that since the defendant was serving as head constable in the police department and also operated two hotels. The trial court granted interim restitution allowance. Defendant's earnings were, in fact, a question that needed proof because the exact earnings data of the defendants was not available, even the defendant's monthly salary was not obtained from the record. The applicant stated that the defendant was running two hotels and none of the two hotels were earned in good words, either in the petition or in the rehabilitation case The trial court had the right and authority to temporarily correct the amount of interim restoration. If I was to establish that the defendant's income data after recording the evidence of the parties, he said that in the light of the evidence brought to him, the court had to modify or amend the quantum of restitution. May be, in the absence of any material on record, the interim reinstatement of the applicant's lawyer's position will not be accepted Therefore, it cannot be increased. Exercise the constitutional jurisdiction of the High Court unless the evidence is filed by the trial court
