SHAHZADA versus MUHAMMAD USMAN

Section 15 (2) (i) (vii) and 15 Constitution of Pakistan (1973), Article 199 Constitutional application on the basis of instability in payment of rent and personal necessity with the rent controller withdrawn on the basis of personal necessity. The application was allowed, when the default basis for the payment of rent was rejected by the appellate court of rent control by the rent controller in a consensus on the case. No facts were kept secret in the series. It was agreed by the appellate court that, as a finding of fact was found, the High Court would have a hard time reconsidering decisions or decisions where there was a coherent finding of facts through two forums.
