Section 13 Civil Code of Conduct (V8 1908), Section 103 and O XXI, 100 Rent Controller shall be enforced as a party on the basis of an agreement to sell the application, and the appellate court has also moved for the interests of the applicant. The appeal filed by the applicant was dismissed and the possession was handed over. The petitioner, in the interest of the plaintiff through the hanging court, had filed an application under section 103, OXXI, R 100, read with the CPC requesting the reinstatement of possession. Was allowed to have the appeal filed by the defendants accepted and the possession restored. The plaintiff petitioner held that the applicant is the owner of the disputed property, cannot be filed by any other person on the basis of his claim on the contract to sell the applicant as party petitioner. Was filed, in fact the defendants were ever executed in favor of a contract to sell the money through a petition. No rights were created in favor of any person and the only right that was available to such person was to file a special performance lawsuit that took over the tenant as if he had made that tenancy. But the cover he received from him was to be emptied and after that if his trial was made for specific performance, he could regain control of the power of such an injunction. The applicant was also not a tenant and had no right to file an objection. The pending court-based petitioner will submit the questioned legal right to the justices.
