The complainant and the eyewitnesses, both real brothers of the deceased, had no enmity or any strong motive for making false accusations in the case and they explained their presence on the occasion. The ocular evidence was consistent with all the material aspects of the case, quite natural and inspiring confidence. The medical evidence supported the ocular testimony, the incident taken by the accused in the special plea could not be substantiated on his record, and it looked like it was an afterthought. For a year and ten months, the accused was held guilty of playing a more important role in his crime. On that occasion, the incident happened suddenly without any trouble.
