On the occasion of the review by the defendant in the court of the Additional District Judge, the award was made a role of the court, accordingly the decree was passed and the defendant's request was dismissed by a decree. The plaintiff asserts that the trial court discontinued his right to present his evidence without notice and granted an unenforceable verdict without a record of material evidence. That they were not given any notice to join the trial as the trial court did after receiving the review from the court and although the case was postponed for the defendant's evidence, neither No proof was filed or a request was received on a due date. Submitted by the respondent for postponement, the trial court did not justify the closure of the defendant's right to present evidence. The trial court decided the trial of the case without any material evidence. In favor of the verdicts, without allowing any technicality to thwart the course of justice, the trial was referred to the trial court, after the decision was made to allow both parties to present their evidence.
