CHIEF EXECUTIVE HESCO (WAPDA), HYDERABAD versus SIKANDAR ALI KHAWAJA
Sections 3 and 5 Service Tribunals Act (LXX of 1973), Section 4 Constitution of Pakistan (1973), Article 212 (3) Compulsory Retirement from Employee Employee of WAPDA, Shocked by Appellant, Shocked by Chief Engineer The allegation of issuance of notice is due to the fact that the inquiry by the service tribunal on the legality of changing the penalties for reducing the time scale to three years without any collective effect has been brought against the Appellant Chief Engineer. There was no regular inquiry to prove it because it was the competent authority to issue notices. The appellant did not challenge the sentence awarded to him by the service tribunal, which reflects his involvement in the charge. The trial was based on the proper definition of the material available on the record.
