Medical evidence supporting the prosecution version proved that the victim was subjected to rape, but he did not link the accused to the case. There is no possibility of punishment in the case. The accused can be acquitted. At any stage of the trial the recording of the evidence of the seven witnesses of the prosecution by the trial court was not sufficient to refute the accused's request. The trial court failed to exercise its jurisdiction under the law. The defendants transferred under Section 265 = K. , The CRP was accepted and on that occasion they were acquitted of the charge if allowed to request a review.
