The complainant police officer did the patent illegal work and all proceedings, including investigation and submission of challan, were dismissed and the state's reasoning on it was suspended. It is suggested that the accused can avail of this under Section 249A. The CRPC could not proceed to trial court because of its acquittal, as it would be a futile attempt to cover up the accused's FIR. Under the circumstances the FIR was abolished
