Sections 9A, 11 and 13 constitution of Pakistan, Article 199 Constitution Petition of Constitutional Petition Holdings, challenged the order passed by the Executive District Officer (Revenue) and prayed that it be restored to the possession of the suit land. The Executive District Officer (Revenue), who appeared before the Member Board of Revenue, but did not accept the treatment provided by the applicant under the law. And instead, the constitutional jurisdiction consisted of a number of contentious questions addressed to the High Court, including the question of restitution of occupation which could not be infused with the constitutional jurisdiction of the High Court. Nor can the decision on the issue of occupation be made especially when the applicant had given up the available alternative, the constitutional application was dismissed.
