YAR MUHAMMAD versus SECRETARY, FINANCE DEPARTMENT, GOVERNMENT OF PUNJAB
Section 2 of the Punjab Service Tribunals Act (IX of 1974), Sections 4 of Pakistan, Arts 25 and 212 (3) denies the secretariat allowance that the appellant (retired employee) has been refused such allowance to the appellant. Retired before he resigned. The Punjab Secretariat Allowance (Withdrawal) Act, 1997, thus, entitles him to receive such allowance as part of his pension. And since some service employees were still being allowed such allowance after the Punjab Secretariat Allowance (Return) Act 1997, such allowance was to be treated as such by the service tribunal as an executive. The order was approved, that is, through finance, Department Letter No. FCPC2 1/88, dated 8-8 1988, the legislature had the power to withdraw or affect a person's previous rights. Such allowance was withdrawn by the Punjab Secretariat Allowance (Return) Act 1997 that such an executive was appointed. This order will never be considered illegal, if it is committed by the authority, the standard for applying the rule of equality cannot be made.
