FIDA HUSSAIN versus MST. SAIQA

Article 199 Recording of the Constitution Petition Conflict Statement Respondents filed a constitutional petition before the High Court against the appellants and policemen for harassing themselves and their children. The appellants specifically denied the defendant's allegations and also submitted some documents in support of which the record of the conviction was required to record the facts and the inquiry into the facts was based on the statement of the High Court. Alias and the appellants did not provide any opportunity to examine the statements and passed the order that the High Court did not have the validity to resolve the controversial question of fact in the use of the Constitution. The jurisdiction under Article 199 of the Constitution was not sustainable in view of the law passed by the High Court, therefore, it was set aside by the Supreme Court under which the appeal was allowed.
