INDUSTRIAL DEVELOPMENT BANK OF PAKISTAN versus IMPERIAL PIPE INDUSTRIES PRIVATE) LIMITED
The Appellant Bank, pursuant to Section 19 decree, suspended the banking court's order under which it allowed the defendant to withdraw 25% of its bid, when it decided to lend property under section 19 of the financial institutions. Submitted after successful bidder in sale of Respondents to the (Finance Recovery) Ordinance, 2001, requested for withdrawal on the basis that Appellant Bank represented that it was the only bank published to invite bids for the sale of property. The declaration of solidarity was an advertisement. Nowhere has it been mentioned that the sale would be subject to the banking court's final order and that the court was involved in auctioning the property, therefore, it was justified in assuming that the appellant bank would confirm that. Appellant Bank was not able to display it. Any document or communication that confirms that the bank's view of the order informs the bidders was authorized by the Banking Court to withdraw its bid from the respondent auctioneer, according to the banking court. No illegal item was found in the defamation order, the appeal was dismissed
