R5 (2) (e) (ii) Constitution of Pakistan, Article 212 Modification of rules affecting the promotion rights of employees Employees (Respondents) were working as Sub Engineer in WAPDA and BS16 (Return) was amended in Rule 5 (2) (e) (ii) of the WAPDA (Water Wing) Service of Engineer Rules 1968, whereby the terms of the amendment to take office in BS 16 were terminated, And all the engineers who were otherwise educated deserved to be considered. In terms of the amended rule, the appointment of employees to develop junior engineers was that twenty-six (26) vacant posts were available prior to the amendment, and employees were entitled to development on such vacant positions on the basis of the sanitary list. After the introduction of the amended rule, those who did not join the BS16 seniority list were allowed to compete with employees for promotion, and this amended rule was designed to help employees suffer. No permission can be granted, for those who were entitled to a valid rule for publicity before the amendment against vacant seats was worked out and if any right was created in favor of an employee under the old rule, then this amendment rule Cannot be taken on the basis of allowing twenty-six contests. Before the rule was amended, the vacancies were vacant, and employees were entitled to develop such posts under the seniority list, but the department did not develop them without providing a plausible explanation.
