Article 42 and Civil Code Code of Civil Procedure (v. 1998 1998 x 1998), Axli, Arr. 23 and 24, order the suit to be passed by the trial court and the trial court's decision on the remand of the defendant. The case was set by the lower appellate court and the matter was referred to the trial court. The lower appellate court justified the decision and determined the same decision after detailed discussion on each point, however, remanding the matter to the trial court at every point. The observed party can cause prejudice to any party. The impugned trial court should have been avoided and so on. The High Court set aside the decision of the lower appellate court and, with the consent of the parties, remanded the matter to the lower appellate court for a fresh decision on the appeal, which allowed the review.
