At the time of the allotment of the lands, the defendants were within three miles of the prohibited zone, but at the time of the grant of proprietary rights, the notification was shown within the bounds of five miles, for the purpose of granting the property rights. The location of the land was to be decided along with the date of the allotment and decision date on the grant of ownership rights. In the Veda case, the decision was taken under notification of 1979, and at the time of allotment the land was outside the prohibited zone. In such cases, it cannot be said that the GPC review was excluded from decisions and injunctions in any sense of law or jurisdiction within the meaning of section 115.
