MUHAMMAD NAWAZ versus STATE
Sections 7 (b), 7 (h) and 7 (g) of the Criminal Procedure (XLV of 1860), Sections 324, 353 and 427 of the West Pakistan Arms Ordinance (XX of 1965), Section 13 of the Incomplete Charge Frame Trial Court The charges were made under the provisions of sections 7 (b), 7 (h) and 7 (g) of the Anti-Terrorism Act 1997 and section 13 of the Pakistan Arms Ordinance, 1965, but PPC offenses, Sections 343, 353 and Under 427, the crimes committed by the accused were ignored. Under the Code mentioned in the Code of Conduct and the Anti-Terrorism Act, 1997, there were different offenses and different charges were to be imposed for the offenses, the trial court had made clear illegal proceedings in framing the incomplete charge. The trial court was remanded for trial in the new courts so the matter should be moved forward.
