Article 212 (3) dismissed by the service department had appointed the inquiry officer by issuing a charge sheet, but the applicant did not respond to the charge sheet and did not even file a case before the inquiry officer who had a previous charge against him. There was no other option but to prosecute. The allegations of the department, in the absence of any defense on record, were legally proved against the applicant, the applicant's position was not approved by the Record Service Tribunal for good reason. The general public importance considered under Article 212 (3) of the Constitution was contained in this petition, which was rejected by the Supreme Court.
