The landlord was entitled to receive the tenant on payment, after which the CPC filed an application under section 12 (2), stating that unanimously Rs 65,000 had not been paid. ? Landlords and their eviction orders, which were based on a compromise, were the result of fraud and misrepresentation. The court said that no fraud was committed on the tenant, however, after the court reached an agreement between the parties through the petition, the court rejected the request. This matter does not fall within the purview of Section 12 (2); the findings of the CPC court cannot be interfered with.
