Sections 302 and 310 of the Criminal Code (v. 1898), the criminal heirs of section 345, were unmarried, leaving the father of their father, brothers, sisters and stepmother, and promoting the crime. As a result, the trial court accused were acquitted, brothers, sisters and stepmother of the deceased objected to the crime on the basis that they too were included in the list of legal heirs, therefore, without their consent. The crime could not be further complicated.
