SARTAJ AND OTHERS versus MUSHTAQ AHMAD
Sections 302 and 310 of the Criminal Code (v. 1898), the criminal heirs of section 345, were unmarried, leaving the father of their father, brothers, sisters and stepmother, and promoting the crime. As a result, the trial court accused were acquitted, brothers, sisters and stepmother of the deceased objected to the crime on the basis that they too were included in the list of legal heirs, therefore, without their consent. The crime could not be further complicated. Trial for the Defendant's Legal Heritage The legitimate mother was not the heir of the disputed stepmother of the deceased's brothers and sisters were also not the legal heirs of the deceased. There was no difference between the Sunni and Shi'ite schools regarding the departure by the father of the slain brothers and sisters, so the High Court's decision was based on a misunderstanding of the correct legal position.
