SHEIKH MUHAMMAD SHAHZAD versus NAVEED ANWAR SETHI
Section 22A & 22B of the Constitution of Pakistan (1973), Article 199 Constitutional application for a dispute over possession of property on the application of justice under section 22A & 22B, CRPC. Can issue registration orders. The respondent could not, however, instruct the police to interfere with the possession of the property. The contention is that because of the administrative order of Justice of Peace, it was not capable of constitutional jurisdiction of the High Court, without any jurisdiction and could not be considered as an order of restriction, the constitutional jurisdiction of the High Court order. The authority challenged that the police be directed to restore possession of the property towards this request, however, the provisions of section 22A&22B were beyond the powers granted to the Justice of the Peace.
