KHURSHEED AHMED THROUGH ATTORNEY versus FAYYAZ AHMED
Clauses 273 and 278 of the Partition Act (IV of 1893), Section 4 of the Special Relief Act (I of 1877), Section 454 Civil Procedure Code (V 1908), Section 11 suit administration, division and permanent jurisdiction discrimination rule Alleges that after the administration's letter was approved, the defendant and other legal heirs of the deceased were trying to evict him and sell the property in the case of the plaintiff's complaint, which relates to a controversial petition filed with the District and Sessions. The judge was filed in court. In which the letter of administration was given and the order to issue such letter to the administration was challenged in the appeal which was pending the plaintiff simply stated that the case was filed only to obtain the fair value of the property. Was gone and the plaintiff will not be evicted from the property. There was no reason or reason to justify maintaining the Letter of Administration with respect to postponement as the Competitive Property Ct was already approved under Section 11 of the CPC as the suit was filed with Race Judesta. Was stopped under the principles of the same because a similar dispute was decided between the parties and an appeal is pending.
